Terms & Conditions
1. Booking
A booking is confirmed once the required booking fee has been received and written confirmation has been provided by Mark Nicholas Photography.
2. Payment
A non-refundable booking fee may be required to secure your chosen date.
The remaining balance must be paid before the photography session or event unless otherwise agreed in writing.
Payment can be made by bank transfer or other agreed payment methods.
3. Cancellations & Rescheduling
If you need to cancel or reschedule your booking, please notify Mark Nicholas Photography as soon as possible.
Booking fees are non-refundable unless agreed otherwise.
Where possible, every effort will be made to accommodate alternative dates.
4. Photography
Every reasonable effort will be made to capture all important moments requested by the client. However, due to the nature of live events, specific photographs cannot be guaranteed.
5. Image Editing
All images are professionally edited in the photographer’s own style.
Raw (unedited) image files are not supplied.
6. Delivery
Images will be supplied via a secure online gallery.
Delivery times will vary depending on the type of photography but will normally be advised at the time of booking.
7. Copyright
Copyright of all photographs remains with Mark Nicholas Photography in accordance with UK copyright law.
Clients receive a licence for personal use unless otherwise agreed in writing.
Commercial use requires prior written permission.
8. Image Usage
Mark Nicholas Photography may use photographs for portfolio, website and social media purposes unless the client requests otherwise before the photography session.
9. Client Responsibilities
Clients are responsible for:
Arriving on time.
Obtaining permission where photography is required.
Ensuring all required participants are available during the session.
Delays caused by the client may reduce available photography time.
10. Equipment Failure
Professional equipment is maintained to a high standard and backup equipment is carried whenever practical.
In the unlikely event of complete equipment failure or circumstances beyond reasonable control, liability is limited to the return of any monies paid.
11. Force Majeure
Mark Nicholas Photography cannot be held responsible for circumstances beyond reasonable control including, but not limited to:
Severe weather
Road closures
Venue restrictions
Illness
Government restrictions
Acts of God
Where possible, an alternative date will be offered.
12. Limitation of Liability
Every reasonable care is taken throughout the booking process.
Liability shall not exceed the total amount paid by the client for the photography services provided.
13. Acceptance
Payment of the booking fee or invoice confirms acceptance of these Terms & Conditions.
